1. The service. StartDialing provides software that places outbound phone calls and text messages using AI voice agents on your behalf, plus tools to manage contacts, campaigns, and results. You are the sender and the caller of record for all communications initiated through your account.

2. Your account. You must provide accurate information, keep your credentials secure, and are responsible for all activity under your account. One person or business per account unless we agree otherwise in writing.

3. Billing. Plans and per-batch credits are billed through Stripe. Subscriptions renew automatically until cancelled and grant batch credits each cycle. Credits are consumed when a batch is submitted and are non-refundable once a batch begins dialing. Prices may change on 30 days' notice. Purchases of phone numbers pass through carrier costs.

4. Acceptable use. Your use of the service is governed by our Acceptable Use & TCPA Compliance Policy, which is incorporated into these Terms. Compliance with all applicable calling, texting, privacy, and consumer-protection laws is entirely your responsibility as the caller.

5. Your representations. You represent and warrant that you have the legal right to contact every number you upload, that you hold any consent the law requires, and that your scripts and offers are truthful and lawful. You are solely responsible for the content of your campaigns.

6. Indemnity. You will indemnify and hold harmless StartDialing, TruITT, and their operators from any claim, fine, penalty, or liability (including TCPA statutory damages and attorneys' fees) arising from your use of the service, your contact lists, your consent practices, or your violation of these Terms or the Acceptable Use Policy.

7. Suspension. We may suspend or terminate any account immediately, without refund, for suspected illegal use, high complaint or spam rates, carrier violations, or any breach of the Acceptable Use Policy.

8. Disclaimers & limitation of liability. The service is provided "as is," without warranties of any kind. We do not guarantee answer rates, appointments, deliverability, or outcomes. To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the three months before the claim.

9. Not legal advice. Nothing in the product or these Terms is legal advice. Consult your own counsel about TCPA and telemarketing compliance before running campaigns.

10. Changes & governing law. We may update these Terms; continued use means acceptance. These Terms are governed by the laws of the State of Colorado, USA.
