Acceptable Use & TCPA Compliance Policy
You are the caller. These rules keep you — and us — on the right side of the law. Last updated July 2026.
You are legally the caller and sender. StartDialing is a tool. When your agent dials or texts a number, that call is made on your behalf and you bear full legal responsibility for it under the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and carrier rules.
1. Consent. You must have a lawful basis to contact every number you upload — prior express consent, prior express written consent where required (e.g. for marketing calls/texts using an autodialer or artificial/ prerecorded or AI voice), or an established business relationship where that exception applies. AI-voice outbound calls are treated as artificial/ prerecorded voice under the TCPA and generally require prior express written consent for marketing. Do not upload purchased or scraped lists you lack consent to call.
2. Do-Not-Call. You must scrub against the National Do Not Call Registry and honor internal and state do-not-call lists. You must immediately suppress any number that requests to stop, and honor STOP/opt-out keywords on text.
3. Calling hours. No calls or texts before 8 a.m. or after 9 p.m. in the called party's local time, and comply with any stricter state limits.
4. Identification & AI disclosure. Your agent must identify you / your business and, when asked, disclose that the caller is an AI/virtual assistant. Your caller ID must be accurate and not spoofed. Several states require affirmative disclosure that the caller is AI — comply with them.
5. Registration. For texting, you must complete A2P 10DLC brand and campaign registration before sending. Unregistered traffic will be filtered or blocked by carriers.
6. Prohibited uses. No calls or texts that are fraudulent, deceptive, harassing, threatening, or that promote illegal goods or services; no debt-collection without proper licensing; no impersonation; no contacting numbers you have no consent or relationship to reach.
7. Consequences. TCPA violations carry statutory damages of $500–$1,500 per call or text — liability that is yours, not ours. We may suspend or terminate accounts that generate high complaint rates, carrier violations, or suspected unlawful activity, and we will cooperate with lawful requests from carriers and regulators.
8. Records. Keep your own records of consent. We may retain call logs, transcripts, and registration data as described in our privacy practices.
